These Terms and Conditions govern WordPress Care Plan subscription services provided by Cardinal South Enterprises, LLC, DBA Cardinal South (“Cardinal South,” “we,” “us,” or “our”).
By subscribing to a WordPress Care Plan, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
Cardinal South offers three WordPress Care Plan subscription levels. Your services, included hours, monitoring frequency, and applicable discounts are determined by the plan to which you are actively subscribed.
The “Essentials” Care Plan | $39/month
The Essentials Care Plan includes:
The Essentials Care Plan does not include prepaid monthly content update hours.
The “Pro” Care Plan | $99/month
The Pro Care Plan includes:
The “Performance” Care Plan | $179/month
The Performance Care Plan includes:
WordPress Care Plans are ongoing, month-to-month subscription services.
Your subscription begins when your first payment is successfully processed and remains active as long as the subscription remains current or until either party cancels the service.
All Care Plans require automatic electronic payment. By subscribing, you authorize recurring charges to the payment method provided at checkout at the rate associated with your selected Care Plan.
A failed or missed payment may result in suspension of Care Plan services until the account is brought current.
The Pro Care Plan includes 1 hour of content updates per month, and the Performance Care Plan includes 2 hours of content updates per month.
Included hours may be used for content updates and website work performed by Cardinal South on the website associated with the Care Plan.
Unused included hours may roll over while the subscription remains continuously active, up to a maximum of six months’ worth of the subscriber’s current plan hours.
Therefore:
If a subscription is canceled or downgraded, any unused accumulated hours are immediately forfeited and have no cash or refund value.
Work exceeding the content update hours included with a Pro or Performance subscription will be billed separately if approved by the customer.
Cardinal South’s standard hourly rate for this work is currently $100 per hour unless otherwise quoted.
Applicable Care Plan discounts are:
Cardinal South will notify the customer and obtain approval before performing work that will result in additional hourly charges.
Routine maintenance and services specifically listed under your Care Plan are included in your monthly subscription.
Technical support required because of circumstances outside the normal scope of the Care Plan may be billed separately. This may include issues caused by third-party software, hosting providers, plugins, themes, integrations, client modifications, or other systems outside Cardinal South’s control.
Out-of-scope technical support is billed at Cardinal South’s standard hourly rate, currently $100 per hour, less the applicable Care Plan discount:
Cardinal South will communicate with the customer before beginning additional billable work whenever reasonably possible.
Customers may request to upgrade or downgrade their Care Plan.
Plan changes will generally take effect with the next billing cycle unless otherwise agreed upon by Cardinal South and the customer.
When upgrading, accumulated content update hours from the previous plan remain available, subject to the rollover maximum of the new plan.
When downgrading to a plan with fewer included hours, accumulated hours exceeding the new plan’s rollover maximum are forfeited.
When downgrading to the Essentials Care Plan, all accumulated content update hours are forfeited because Essentials does not include monthly content update hours.
Either the customer or Cardinal South may cancel a Care Plan at any time.
Cancellation takes effect at the end of the customer’s current paid billing period unless otherwise agreed upon.
Once canceled, future recurring charges will stop and Care Plan services will end at the conclusion of the applicable billing period.
Payments already processed are non-refundable, including payments for partial months or unused services.
Any accumulated content update hours are forfeited upon cancellation and cannot be redeemed for cash, transferred, or used after the Care Plan ends.
WordPress websites rely on third-party products and services that may include hosting providers, domain registrars, plugins, themes, APIs, integrations, software platforms, and other vendors.
Cardinal South is not responsible for failures, outages, security incidents, incompatibilities, discontinued products, changes, or other problems caused by third-party services.
Unless specifically stated otherwise, Care Plan pricing does not include third-party hosting fees, domain registration or renewal fees, premium plugin or theme licenses, or other third-party subscription costs.
If a third-party issue requires work outside the scope of the customer’s Care Plan, Cardinal South may provide an estimate or perform the work under the applicable discounted technical support rate.
Customers remain free to access and modify their websites while subscribed to a Care Plan.
However, Cardinal South is not responsible for errors, damage, downtime, security vulnerabilities, or other problems caused by modifications performed by the customer or another third party.
Work required to diagnose or correct such problems may be considered out-of-scope technical support.
Cardinal South uses reasonable maintenance, monitoring, backup, and security practices based on the customer’s selected Care Plan.
No website, server, security system, or backup system can be guaranteed to operate without interruption or completely prevent hacking, malware, data loss, downtime, or other failures.
Care Plan monitoring and maintenance are intended to reduce these risks but do not constitute a guarantee that such events will not occur.
Customers are responsible for maintaining secure passwords, controlling authorized access to their accounts, and appropriately managing third-party tools and services connected to their website.
Care Plan customers may submit eligible website update and support requests to Cardinal South.
Cardinal South will make reasonable efforts to respond to and complete requests in a timely manner. Care Plan subscriptions do not guarantee immediate, same-day, or emergency service unless Cardinal South specifically agrees to such service.
Completion time may depend on the scope of the request, current workload, customer responsiveness, third-party services, and other circumstances.
Cardinal South may periodically modify Care Plan features, pricing, monitoring practices, included services, discounts, or these Terms and Conditions.
Customers will receive reasonable notice before a material change affecting an active subscription takes effect.
Any change to the recurring subscription price will be communicated before the customer is charged the new amount. When affirmative consent is required by applicable law, Cardinal South will obtain that consent before applying the change.
Customers who do not wish to continue following a material change may cancel their subscription before the change takes effect.
Non-material updates, clarifications, administrative changes, or changes that do not materially affect the customer’s subscription may become effective when these Terms are updated.
The “Last Updated” date at the top of this page identifies the most recent revision.
Cardinal South will perform Care Plan services with reasonable care but does not guarantee that a website will be continuously available, completely secure, error-free, or compatible with all third-party software and services.
To the fullest extent permitted by applicable law, Cardinal South will not be responsible for indirect, incidental, consequential, or special damages arising from website downtime, third-party failures, security incidents, data loss, customer modifications, or circumstances outside Cardinal South’s reasonable control.
By purchasing or maintaining an active Cardinal South WordPress Care Plan subscription, you acknowledge that you have reviewed and agree to these Terms and Conditions, including the scope of your selected Care Plan, recurring automatic billing, cancellation policies, content update policies, and applicable service limitations.
If you do not agree to these Terms and Conditions, you should not purchase or continue a WordPress Care Plan subscription.
